FST issued the Judgment for grant of timescale promotion in favour of PS/SPS (BS-17, 18 & BS-19) with all back benefits

Case filed by Muhammad Iqbal, PS (BS-17), MS Wing, Establishment Division, Islamabad in Appeal No. 1710(R)CS/2019, Judgment issued on 17.11.2021

Before Dr. Mujeeb Ur Rehman Khan and Dr. Muhammad Hashim Popalzai, Members, Federal Service Tribunal (FST)

The appellant has prayed for issuance of a direction to the respondents for grant of timescale promotion from BS-17 to BS-18 and consequently to BS-19 with all back benefits. The appellant was appointed as Steno-typist in the respondent department (Establishment Division) in year 1978 and subsequently promoted to the post of Stenographer which was upgraded BS-16 and re-designated as APS vide order dated 04-04-2012 and he was lastly promoted as Private Secretary (BS-17) vide order dated 27.08.2018. He retired from service on attaining the age of superannuation on 31-02-2020.

Hon’able Supreme Court of Pakistan which was dismissed by the Hon’able Apex Court vide Order dated 11.06.2020 in CP No. 4852/2019. The Secretary Finance Division filed a Review Petition against the above mentioned Judgement of FST as well as Order of the Hon’able Supreme Court of Pakistan. The same was also dismissed by the Hon’able Supreme Court vide order dated 23-04-2021 in CRP 382/2020.

The instant appeal is accepted. The respondents (Establishment Division & Finance Division) are directed to calculate the service rendered by the appellant in BS-1 to BS-15 @ 1/4 and 1/2 of BS-16 for granting BS-18 from the date he completed five years service in BS-17 in accordance with the Formula of O.M. dated 02-06-1983. He is also entitled to all back benefits.
