At the very outset of the arguments learned counsel states that he does not press this petition and would be satisfied it this petition be treated as a pending representation before Respondent No.1, (Establishment Div) who should redress the grievance of the Peitioner in accordance with law expeditiously.

2. The request of the learned counsel is tenable. Therefore, a copy of this petition and all the "Annexures" attached with it be sent to Respondent No.1 (Estb.Div), who shall treat it as a pending representation on behalf of the Peitioners and decide upon his grievance in accordance with law through a speaking order after hearing all the necessary parties within one month of receipt of certified copy of this order. Complaince report shall be submitted to Deputy Registrar (Judicial) of this Court. Disposed of accordingly.


Prayed by the Petitioners
i) The respondents may be directed to consider to up-grade the post of Upper Division Clerk (UDC) BS-09 to any scale high to the scale of Junior Auditors in order to avoid discrimination and to meet the ends of justice.
ii) Any other relief this Hon'able Court deems fit and appropriate may also be granted.

As the merits of the matter are concerned, we may again reiterate the stance of the respondent No. 1, Secy Finance Division in particular paragraph 3 of his concise statement which is consistent with the statement made on 16-12-2015. The perusal thereof goes to show that the judgment passed by the Tribunal is in the process of implementation and will indeed be implemented as undertaken before us through the consise statement as also the statement made on 16-12-2015. With this observation, the review petition is disposed of.

The respondents are directed to take necessary/appropriate steps to finalize the matter by removing the dispairty in the pay scales of LDC and UDC which has occurred among the similar posts of different organization of the Federal Government as well as of the Provincial Governments. The Consitutuion of Islamic Republic of Pakistan vide Article No. 25(1) read with Article 38 also states that dispairyt in pay scales of various classess of service of Pakistan must be resolved. The process shall be completed by the respondents within a period of two months from the date of receipt of this judgment in their offices. (This appeal is disposed of in the above terms)
