Update Implementation of Judgment - Hearing on 27-08-2015 Court-I:: Before Mr. Justice (R) Sheikh Ahmed Farooq Chairman and Mr. Muhammad Arshad Bhatti Member:: As per court order on last hearing 27-08-2015 Mr. Khizar Saleem Khokhar, Addl Director FIA is present in person. The respondent No. 2 have field reply of the instant Misc Petitions wherein it is mentioned that Qari Abdul Rasheed, Advocate has been nominated to the file a CPLA in the Hon'able Supreme Court of Pakistan against the judgment of this Tribunal dated 08-04-2015 but so far no date has been fixed. Be that as it may, it is an established principle of law that mere filing of an appeal does not ipso-facto empowers a department not to implement the judgment. Rather, the department is bound to implement the judgment in the absence of any injuctive order or suspension of the operation of the impugned judgment. "A final opportunity is being granted to the respondents (FIA) to implement the judgment of this Tribunal dated 08-04-2015 in letter and spirit, failing which necessary coercive measures, admissible under the law, shall be adopted against them. However, in case the operation of the judgment of this Tribunal dated 18-04-2015 is suspended by the Hon'able Supreme Court prior to the next date of hearing, the respondents may inform this Tribunal, accordingly".
