Hon’able FST has been dismissed the Appeals of Direct PA&AS Officers (BS-17/18) against Up-gradation of Departmental Cadre i.e. AO / AAO

Islamabad:: On Wednesday May 4, 2016 in Court-1, Hon’able Chairman of Federal Service Tribunal Justice (R) Syed Zahid Hussain and Syed Hamid Ali Member has been dismissed the Appeals of CSP-PA&AS Officers (BS-17/18) against the Up-gradation of Departmental Cadre posts AO (BS-17 to BS-18), AAO (BS-16 to BS-17) /Auditors.

Theses Appeals No. 1259-64 (R)CS/2015 Filed by Direct Officers (PA&AS) Mr. AitzazI Ahmad, Mr. Ikram Rauf (ACMA-RC), Pirzada Wazir (ACMA-OP), Ammara Younis & Others through Shoaib Shaheen, Advocate Supreme Court of Pakistan & Mr. Owais Ahmed Advocate.

During arguments in court, employees referred, this case has already come and decide before the High Court. Secondly Service Tribunal have no Jurisdiction to entertain an Appeal relating to Up-gradation as per Supreme Court.

گزشتہ روز فیڈرل سروس ٹریبونل کے سپیشل بنچ جس کی سربراہی چیئرمین ایف ایس ٹی جسٹس ریٹائرڈ سید زاہد حسین کررہے تھے نے محمود ایاز اور دیگر آڈٹ آفیسرز کی کمبائن سینٹارٹی کیس کی نظرثانی اپیل پر بحث سننتے ہوئے اس پر فیصلہ محفوظ کرلیا ہے۔ یہ کیس فیڈرل آڈٹ ، آڈیٹر جنرل آف پاکستان اور کنٹرولر جنرل اکاؤنٹس کے آڈٹ آفیسرز نے دائر کیا تھا جس میں ان کا موقف تھا کہ انہیں بھی ڈائریکٹ آفیسرز کی طرح گریڈ اٹھارہ سے انیس میں پروموشن سینٹارٹی کی بنیاد پر دی جائے۔ یاد رہے کہ افتخار احمد صدر آل پاکستان اے او ایسوسی ایشن نے اس جدوجہد میں بہت نمایاں کردار ادا کیا ہے۔ اُن کی معاونت سید فیض علی شاہ کررہے ہیں۔ اور یہ لوگ بہت پرامید ہے کہ فیصلہ ان کے حق میں ہوگا۔۰

1. Direct the Respondent No. 1 to determine and finalize Inter-se Seniority of the Appellant amonth the officers of the Inter-Departmental Cadre of the PAAS (Pakistan Audit & Accounts Services) to para 4(c) of the Framework of Rules and Procedure of PAAS, with effect from date of regular promotion/up-gradation in BPS-18.

2. Direct further to consider the Appellant for promotion on post in BPS-19 strictly in accordance with the seniority list prepared after including the name of the appellant.
