Judgment / Court Order
In the first place the policy of up-gradation in regard to the service related issues of the civil service fails which the exclusive domain of the Establishment Division. The policy of up-gradation introduced with the approval of the Prime Minister, could not be subsequently interfered with by the Finance Division through an Office Memorandum and that too, without the approval of the Government. This Court in the case of Chief Commissioner, Inland Revenue and another Vs Muhammad Afzal Khan and others (Civil Appeal No. 992 of 2014 dated on 11.01.2016) while discussing the term "up-gradation" has held that the Government can grant up-gradation through a policy, which cannot be interfered with the Finance Division through Office Memorandum.

We do not find any infirmity int he impugned judgment which could warrant interference by this Court. Consequently, this petition being misconceived is accordingly dismissed and leave refused.

IHC has been already judgment passed in Writ Petition No.3851/2014 restoring the benefits of Senior Private Secretaries with regard to rental ceiling and premature increments.

خالد صفدر سینئر پرائیویٹ سیکرٹری فیڈرل بورڈ آف ریونیو کے مطابق اسلام آباد ہائی کورٹ نے فنانس ڈویژن کی جانب سے فائل کردہ انٹرا کورٹ اپیل کو مسترد کردیا ہے۔ اور کہا ہے کہ اسلام آباد ہائی کورٹ کے سنگل بنچ کے فیصلے جو کہ رٹ پٹیشن نمبر ۲۰۱۴۔ ۳۸۵۱ جس میں سینئر پرائیویٹ سیکرٹریز کے گریڈ انیس کے تمام مالی فوائد اور پری میچور انکریمنٹ ، گریڈ انیس کی رنٹل سیلنگ اور دیگر مراعات پہلے ہی بحال کرچکا ہے۔

اسلام آباد ہائی کورٹ کے جانب سے اس سلسلے میں جلد کورٹ آرڈر جاری کردیا جائے گا۔

Final Order passed by Hon'able Justice Mr. Noor ul Haq N. Quershi Islamabad High Court	It is held that impugned Office Memorandum dated 25-07-2014 has no value in the eye of law. So, the same is set aside. Consequently, upgradation of Private Secretaries as Senior Private Secretaries mode through Office Memorandum dated 23-12-2011 will be considered as promotion to save them from financial loss as well as loss of premature increments.. With above observations, instant writ petition stands disposed of.

11th-Sept 2014 Hearing in High Court:: The Respondents appeared before the Honourable Justice Noor-ul-Haq N. Qureshi and showed their inability for submission of comments in time and requested for two weeks time for submission of the comments. The undersigned reiterated for suspension of operation of the office memorandum dated 25th July, 2014. Finally it was decided that the Respondents may be given 10 days more time for submission of comments. In case of failure to submit comments within ten day, it is hoped that we will get stay from the Court Inshallah.
