Grant of 20% Special Allowance to attached departmentsOn 04-02-2020, Before Justice MR. JUSTICE MAQBOOL BAQAR MR. JUSTICE YAHYA AFRIDI MR. JUSTICE QAZI MUHAMMAD AMIN AHMED in Court # 5. The Supreme Court Tuesday ordered payment of 20 percent special allowance to all the federal government employees and observed that the federal government could not discriminate against its employees. A three-member bench of the apex court, headed by Justice Maqbool Baqir, after accepting an appeal filed by the employees of several attached departments of the federal government set aside the Islamabad High Court verdict.

The Supreme Court Tuesday ordered payment of 20 percent special allowance to all the federal government employees and observed that the federal government could not discriminate against its employees.
A three-member bench of the apex court, headed by Justice Maqbool Baqir, after accepting an appeal filed by the employees of several attached departments of the federal government set aside the Islamabad High Court verdict.
Shoaib Shaheen, counsel for the petitioners, submitted that the special allowance was only approved for the employees working in different ministries but denied to the employees of subordinate departments of the ministries.
He asked as to how the government could discriminate against its own employees.
The court observed that the federal government could not discriminate against its employees and ruled that now all the federal government employees will get the special allowance.
It is pertinent to mention that a division bench of the Islamabad High Court had accepted the federal government’s intra-court appeal against the orders of a single-member bench for payment of 20 per cent special allowance to all federal government employees.
The then PPP government had approved a special allowance in March 2013 for the employees of the ministries and divisions of Pakistan Secretariat but it was not given to the employees of the attached departments.
To end discrimination, the employees of other departments, including the Federal government College Teachers Association, Pakistan PWD, departments of communication security, CDA union and Pakistan Council of Science and Technology, approached the IHC in April 2013 challenging that the allowance should also be paid to them.
Twenty-three identical petitions were filed by the employees of various federal government departments and a single bench of the Islamabad High Court, headed by Justice Shaukat Aziz Siddiqui, had directed the federal government on June 18, 2013, to notify the 20 per cent special allowance for all employees.
However, instead of obeying the orders, the government filed an intra-court appeal against the decision of Justice Shaukat Aziz Siddiqui.
After scores of hearings in over five years, a double bench of the IHC decided the mater in favour of the federation of Pakistan on June 13, 2018. Later on the employees moved the Supreme Court against the IHC verdict.

(@RUNNING BASIC PAY/PM) TO THE EMPLOYEES WORKING IN THE FEDERAL MINISTRIES/DIVISIONS
Capital Development Authority Notification No. CDA/FW(G)-44(28)(Pay/Allowances) /2015/3738 dated 02-06-2015The said allowance has already been granted has already been/being granted with effect from 21st January 2015 onward. Hence arrears will be payable with effect from 01-03-2013 to 20-01-2015 to all the employees alongwith pay (one time lump sum)in the next financial year 2015-16.; provision to this effect will have to be made by the DFA-I’s Office in budget estimates for next financial year.
The said benefit will take effect from 01-03-2013 onward applicable to all CDA regular/regular “P” employees and those employed on contract basis against civilian pay scales.

Islamabad High Court (IHC) on 18-06-2013 has made a decision to grant 20% Special Allowance to all the Federal Govt Employees (attached departments). Before Justice Athar Minallah & Justice Aamer Farooq in Court # 4, Islamabad High Court. Mr. Nadeem Arshad S O (Regulation) Finance Division appeared before the Hon'ble DB and requested that Finance Division could not prepare report on Attached Departments due to busy in preparation in budget, therefore 2 weeks more time was requested by him which was accorded by the Court. Awaiting Court OrderISLAMABAD, Sep 26: The Islamabad High Court on Wednesday directed the Finance Ministry to issue the notification with regard to increase in the special allowance of 20% on running basic pay of all the federal government employees by September 30. The court also directed the official of the ministry to submit the copy of the notification before it in next date of hearing as it was granted to the officials of the ministries and divisions. A single member bench of the IHC comprising Justice Shaukat Aziz Siddiqui issued the directives after hearing the contempt petition filed by the federal employees of various departments, seeking the implementation of the court orders regarding raise of 20 percent in the basic salaries as being availed by the ministries’ employees.
During the course of hearing , counsel for petitioner apprised the bench that finance ministry was not implementing the court orders and notification of increase in salaries has not issued so far.
He prayed the court to direct the finance ministry to issue notification of increase in salaries in the light of the court direction.
Nadeem Arshad, an official of the ministry informed the bench that the increment in salaries would cost a huge financial burden on the public exchequer.
To this, justice remarked that every one has to implement the court orders and directed the official of ministry to submit the notification till September 30.
Nadeem argued that the federation has filed an intra court appeal against the decision and sought time dill the decision of the case.
The Judge remarked that there was no stay order issued in result of ICA,so finance ministry should implement the orders of the court in letter and spirit.
Justice Siddiqui observed that all government employees should be equally treated and discriminatory attitude would not be tolerated.
The court had ordered on June 18 for 20 percent increase in the basic pay of the federal employees and had directed the federation to grant the raise in salary with effect from 1st March 2013.
After hearing the arguments, the bench admitted the petitions and adjourned the matter for indefinite period.Islamabad High Court's Judgment issued for grant of 20% Special allowance to the all Federal Government Employees
Islamabad High Court (IHC) on 18-06-2013 has made a decision to grant 20% Special Allowance to all the Federal Govt Employees. Earlier in March 2013, Finance Division announced 20% Special Allowance to the Employees of Secretariat and Ministries and Divisions and the Employees of Attached Departments, Semi Govt and Corporations were deprived of this allowance. This allowance will be granted wef 1st march 2013 (Read O.M. No. F.10(2)R-3/2012 dated: 6th Marh, 2013) as the Employees of Ministries & Divisions are availing the same since 1st March 2013. According to Court judgment/Order sheet:
“ The Grant of Special Allowance @ 20% to the employees working in the Federal Ministries/Divisions and withholding of the same from Federal Govt employees of other Secretariat, Departments and Statutory Bodies where Govt Scale are applicable is discriminatory in nature as such offensive to the constitutionally granted rights of these employees. All the Federal Govt Employees are therefore held entitled to Special Allowance @ 20% with effect from the employees working in the Federal Ministries/Divisions have been allowed.”
Shaukat Aziz Siddiqui, Judge - Islamabad High CourtThe Islamabad High Court (IHC) on Tuesday 18-06-2013 directed the federation to increase a special allowance of 20 percent on the current basic pay of all government employees as it was granted to the officials of the ministries and divisions.

The court admitted a number of pleas and ordered that the raise in salary be implemented with effect from March 1, 2013.
A single member bench of the IHC comprising Justice Shaukat Aziz Siddiqui issued the directives after hearing 23 identical petitions filed by the employees of Pakistan Council for Science and Technology including other departments for seeking a raise of 20 percent in the basic salaries as being availed by the ministries' employees.
During the course of the hearing, counsel for petitioner Asad Hussain Ghalib, GM Chaudhry argued that the petitioners and other employees were equally entitled to all benefits extended to the employees of ministry serving in the same scale and under same terms and conditions.
“All employees are equally entitled and eligible for the same benefits, salary, allowance and special allowances which are being extended to the employees of other allied departments,” he said.
They asked the court to direct the ministry of finance and Prime Minister Secretariat to pay the 20 percent special allowance to the petitioners and other employees of the department. Additional finance secretary apprised the bench that there was no special allowance which could be given to corporations and other government departments’ employees. Justice Siddiqui observed that all government employees should be equally treated and discriminatory attitude would not be tolerated.
After hearing the arguments, the bench admitted the petitions and adjourned the matter for an indefinite period.
