Government of Pakistan, Finance Division O.M./Notification No. F.12(9)-Reg.6/2012.pt-1201 dated 12-09-2015According to this Office Memorandum, a meeting was held on 16-10-2015 under the chairmanship of Honourable Finance Minister, inter-alia, it was decided that in order to facilitate the pensioners and to ensure speedy disposal of pension cases in all Ministries/Divisions should appoint Welfare Officers for facilitation of pensioners in all Ministries/Divisions /Departments by 31st December 2015.
Arrears for Restored Pension from Controller Military Pension (CMP) LahoreAll those retired army (JCOs/ORs) and Defence Paid Civilian Pensioners, whose Commuted Portion of Pension has been restored wef 01-12-2001 to 30-06-2013 (as per Finance Division Regulation Wing O.M. No. April vide No. F.13 (13)-Reg.6/2011 dated 11-03-2013) submit their application through their concerned Post Office/ National Bank to the Controller Military Pension, Lahore Cantt. Related Office Memurandum of Finance Division Regulation Wing O.M. No. F.13 (13)-Reg.6/2011 dated 11th March 2013 regarding the Restoration of Pension.In the Notification it is stated that, in continuation of Finance Division O.M No. F.13 (13)-Reg.6/2011 dated 21st January 2013, it has been decided to implement the judgment of Federal Service Tribunal, Islamabad dated 05-01-2012 upheld by Supreme Court of Pakistan vide judgment dated 24-04-2012 in respect of all the equally placed pensioners wef 01-07-2013, in view of the fact that budgetary cover is not provided in the current financial year for this unforeseen expenses.This is subject to the condition that if the constitutional petition to be filed by the Government is accepted by the Apex Court, the Govt would recover the amount of increases in pension on restored portion of pension being allowed to them. The beneficiaries of this O.M are required to furnish an under taking on Judicial Paper for Rs. 50/- as per the format to the concerned Accounts Officer.

Finance Division has challenged common judgment dated 22-02-2012 of the learned Federal Service Tribunal (FST), whereby appeals of the respondents were allowed. The respondents’ claim for payment of pension by addition of Special Additional Allowance dated 23-07-1999, Special Relief Allowance dated 30-06-2003, Adhoc Relief Allowance dated 01-07-2004, Dearness Allowance dated 24-06-2006 and Additional Adhoc Relief Allowance dated 21-07-2009 was allowed and the appellants was directed to recalculate the pension of the respondents by including these allowances. Leave to appeal was granted on 26-06-2012, inter alia, to consider as to whether these allowances are liable to be included in the pensionable emoluments and reckonable towards calculation of pension under law.
We note that the Tribunal has not dealt-with in its impugned judgment the relevant law which was actually applicable to the case in hand but rather has allowed itself to be swayed by principles or decisions which were either not applicable or were not the correct annunciation of law and in doing so came to the wrong conclusion by allowing the appeals of the respondents. Having considered the facts and circumstances of the matter in hand and the applicable law, we are of the considered opinion that the impugned judgment of the Tribunal is not in accordance with law and suffers from legal infirmity and perversity and therefore, is not sustainable. These appeals are allowed and the impugned judgment of the FST is, therefore, set aside. There shall however be no order as to costs.

Finance Div Regulation Wing Islamabad has issued Notification No. 4 (1)-Reg-6/2013-1375 dated 16th July 2013 for the increase in Pension to the Civil Pensioners of Federal Govt including Civil Pensioners of Defence Estimates as well as Retired Armed Forces Personals & Civil Armed Forces Personals wef 01-07-2013 @ 10%. of NET PENSION. Notification of Early Finalization of Pension Cases for the EmployeesGovt of Pakistan Finance Division Regulation Wing Islamabad has issued O.M. No. F.11 (1)-Reg.6/2013 dated 3rd May 2013 in connection with the early finalization of the pension cases for the employees who are being retired from the Govt Service. The purpose of this notification is that the employees who are being retired or retired from Govt service may not suffer any financial difficulty after their retirement. This decision is made after getting number of complaints from the pensioners as they did not get their pension and gratuity within the stipulated period. As you know that an employee is getting his/her salary regularly and all his/her monthly or routine expenses depend on his/her salary. When he/she is retired from Govt service and he/she doe’s not get the pension or gratuity in time, the employee have to face a great financial problem. For the satisfaction of the same employee this decision has been made.
