THE ESSENCE OF THE JUDGMENT
Hon'able Members of FST has been set aside conditions(ii) & (iii) contained in the Finance Division's O.M. No. F.1(3)R-1/2010/2014, dated 10.09.2014. The appellants are held to be entitled to all benefits of BPS-17 including Perks/Privileges, Pre-Mature Increment, Rental Ceiling/House Rent Allowance and Medical Allowance etc with effect from 10-09-2014, the date when the O.M. was passed.

"SUPERINTENDENT CUSTOM/ SUPERINTENDENT PREVENTIVE
& PRINCIPAL APPRAISER" FROM BS-16 TO BS-17
(ONE TIME HIGHER TIME SCALE) W.E.F 18-12-2015 in Custom Dept. FBR
Govt of Pakistan, Revenue Division, Federal Board of Revenue (FBR) Notification No.2997-C-III/2015 Dated 22-12-2015
(Congratulation to all Superintendents from FBR)

As per Notification the approval conveyed vide Finance Division's O.M. No. 1(138)R-1/2015-908 dated 18-12-2015, all the existing regular Prinicipal Appraiser (BS-16), Superintendent Preventive (BS-16) and Superintendent Customs (BS-16) in the Customs Department under the administrative control of FBR are hereby granted one time Higher Time Scale (BPS-17) with effect from 18-12-2015.

The Higher Time Scale is subject to the following terms and conditions:-

One time grant of BPS-17 is allowed to all the regular incumbents of above post, irrespective of their length of service.
In future three (03) years satisfactory service in above cadre/post (BPS-16) is prescribed for the grant of BPS-17 to them.
The recuritments rules, nomenclature/tier of the posts and seniority of incumbents of above posts remain intact.
In future the grant of higher time scale (BS-17) will be subject to fitness of candidate and recommendation of the relevant DPC.
On grant of higher time scale, pay will be fixed at the next above stage in BPS-17 and no pre-mature increment is admissible.
On grant of higher time scale there shall be no change in the entitlement/ admissibility of rental ceiling/House Rent Allowance/ Medical Allowance.

Finance Division directed to refer to this Division's O.M. No dated 10th September, 2014 and state that AGPr, Islamabad and various Ministries/Divisions/Departments have raised certain queries for clarification which have been examined and clarified as under:

With reference to Finance Division’s O.M of even number dated 10th September 2014 on the subject cited above and to clarify that all the existing Superintendents of BPS-16 are required to be granted BPS-17 irrespective of their length of service, therefore, no DPC will be required for this exercise.However, in future, three years satisfactory service would be required for grant of BPS-17 to the Superintendents of BPS-16, therefore, there would be required for subsequent cases to judge their service as satisfactory.

Finance Division is directed to convey that the Prime Minister has been pleased to accord approval to the grant of higher time scale to the Superintendents (BPS-16) in the Federal Government Ministries/Division/Attached Departments/ Subordinate Offices with immediate effect as under:

a) One time grant of BPS-17 to all Superintendents working in BPS-16 irrespective of their length of service.

b) In future three (03) years satisfactory service as Superintendent BPs-16 may be presicribed for grant of BPS-17 to them.

2. The grant of higher time scale will be subject to the following terms and conditions:-

i) The recruitment rules, nomenclature/tier of the posts and seniority of the Superintendents shall remain intact.
ii) The grant of higher time scale will be subject to fitness of candidate and recommendations of the relevant DPC.

فنانس ڈویژن نے ایک بہت طویل عرصے کے بعد سپرنٹنڈنٹ کی پوسٹ کو گریڈ سترہ کا درینہ مطالبہ کسی حد تک پورا تو کردیا ہے مگر اس کے اندر جو کنڈیشن لگائی ہیں وہ غیرمنصفانہ اور سپرنٹنڈنٹس کے ساتھ امتیازی برتاؤ ہے۔ ہم اس فورم کے ذریعے تمام سپرنٹنڈنٹس کمیونٹی سے گذارش کرتے ہیں کہ وہ اس پر عمل درآمد ہوتے ہی اس آرڈر کو کورٹ میں چیلنج کریں کہ اس آرڈر کو ٹائم سکیل پروموشن کی بجائے اپ گریڈیشن تصور کیا جائے ۔ کیونکہ یہ سراسر ناانصافی ہے۔ پورے پاکستان میں باقی تمام لوگ اپ گریڈ ہوکر ہائر سکیل کے تمام فوائد انجوائے کررہے ہیں اور یہ لوگ جو تیس تیس سال سے سکیل سولہ میں کام کررہے ہیں اُنہیں گریڈ سترہ دیا مگر وہ بھی بغیر فائدے کے۔ خدا کا خوف کرو فنانس والو۔ اللہ تم لوگوں کو ہدایت دے۔

In exercise of the powers cornferred by the Finance Department under Notification No. SO(A/Cs)FD/2-1/96, dated 7.12.1996, the Hon'able Chief Justice, Peshawar High Court, Peshawr is pleased to accord sanction to the up-gradation of the post of Superintendents to the court of District & Sessions Judges/ZQs, in Khyber Pakhtuknkhwa from BPS-16 to BPS-17, on completion of 05-years satisfactory service in BPS-16, w.e.f. 01/12/2012.
