Grant of Premature Increment on up-gradation Finance Division Notification F.No. 11(4)R-2/2011-1153/03 Dated 31-05-2013 These orders would be applicable in all cases of up-gradation taken place from 28th January, 2002 onward i.e. the date of Honorable Supreme Court's Judgment passed in Appeal No. 637 of 1998 and would take effect from the actual date of up-gradation of each post.However, the payment of enhanced pay & allowances and arrears on this account would commence from 01-07-2013 in view of the fact that budgetary cover is not provided in current financial year 2012-13 for this unforeseen expenditure.

Islamabad: 4th Oct. 2012 Hon'able FST direct the respondents to grant the Pre-Mature Increment on Up-gradation :: Gulzar Hussain & Noor Muhammad VS M/o Finance (Employees of FST)
Keeping in view, the appeals are not only admitted but are also allowed with direction to respondents to grand pre-mature increment to the appeallants on their up-grdation. The process shall be completed preferably within a period of three months.
PRE-MATURE INCREMENT ON UP-GRADATION || || APPLY ALL UP-GRADED EMPLOYEES
The Honourable Supreme Court of Pakistan in the case of Hamid Akhtar Niazi Vs Establishment Division etc. reported as 1996 SCMR 1185 has held that in case this Court or Service Tribunal decides a point of law, it would be applicable to all civil servants who have not approached the Court or Tribunal and departments should implement the same without compelling the other servants for litigation.
They allowed pre-mature Increment on upgradation to Mr.Faryad the applicant only. This will not applicable on all upgradation.
