THE ESSENCE OF JUDGMENT
Significant to note that even the MAG had not the audacity to deny the claim of the appellants. It is simply trying to hand them on the tenterhooks and to await the endorsement of the Finance Division O.M dated 06-02-2012 by the M/o Defence. As observed earlier, on the basis of the delay by the M/o Defence, the appellants cannot be deprived of their right incessantly which has accrued in their favour because of the notification of 06-02-2012 issued by the M/o Finance. That being the case, we are having no hesitation in accepting these appeals and to direct the respondents to grant the health allowance equivalent to one basic pay of running salary to the appellant w.e.f 01-01-2012. The needful be done within a period of four months.
