ALL PENSIONARY BENIFITES TO PTCL PENSIONERS / EMPLOYEES
AS ANNOUNCED BY GOVERNMENT OF PAKISTAN

The Supreme Court of Pakistan dismissed a review petition filed by Pakistan Telecommunication Employees Trust (PTET) through its MD, Islamabad, Pakistan Telecommunication Company Limited (PTCL) against Islamabad High Court (IHC) order on payment of pension and other benefits to its employees according to government pay structure. 15-pages detail judgment issued on 16-03-2016.
Five Member Larger Bench (on Friday 19-02-2016) of the apex court headed by Chief Justice Anwar Zaheer Jamali and comprising Justice Mian Saqib Nisar, Justice Amir Hani Muslim, Justice Ejaz Afzal Khan and Justice Mushir Alam heard the case and announced short verdict after lengthy hearing of the case.

Justice Amir Hani Muslim remarked that, “ If PTCL was someone’ s personal organisation then he would not have sold it. The government sells Public organizations whenever it likes. The three Judges bench headed by the Chief Justice Anwar Zaheer Jamali dismissed the PTCL Review Petition against the decision of Islamabad High Court. The Court ordered the restoration of pension and other benefits of workers to pre-privatisation terms of employment.
The Chief Justice showed his concern over the Privatisation of public organisation and fate of its employees. Anwar Khalid Senior Advocate appeared and argued the PTCL case. After hearing both the sides the court ordered the dismissal of the petition restoring the benefits of the employees prior to privatisation of the PTCL. I think it is the right decision and must be lauded.
Chief Justice raised the question, what will happen to employees of pubic corporations if the government carries on its policy of privatisation at will. He has raised a pertinent question that concerns the government employees. In the light of this decision & remarks of the learned Judges the government should revise its policy of selling Public assets.

Justice Amir Hani Muslim remarked that PTCL was a state institution but rights of employees were ignored after privatization of the organization.
The apex court also restored the previous status of the employees as they were enjoying before privatization.
Justice Mian Saqib Nisar remarked “If law gives rights to employees then it should be provided to them.” Salary is the basic component of the job but main point is provision of other facilities to employees, he added.
The IHC in its order directed the PTCL to pay pension and other facilities to its employees according to government pay structure.
The court announced short order while the detailed verdict would be announced later.—APP

Case Outlines


Here is detailed verdict by H'SCP.All the appeals filed by PTCL are dismissed hence declaring all employees of PTCL before privatization as "Civil Servants".

As much as 40,000 PTCL Pensioners and thousands of serving employees are now entitled to all benifites announced by Government of Pakistan from time to time.

PTCL Pensioners including some 12,000 widows had been deprived of pension and Medical Allowance increases for last six years as announced by Government of Pakistan.

JUDGMENT

Having thus considered, we do not think a case for review of the judgment of this Court dated 07-10-2011 is made out. These review petitions as well as Civil Petition No. 423 of 2011 being without merits are dismissed.

" پاکستان ٹیلی کمیونیکیشن کاپوریشن کے وہ ملازمین جو یکم جنوری 1996 کو پاکستان ٹیلی کمیونیکیشن کمپنی لممیٹڈ میں ٹرانسفر ھو چکے تھے ان پر statutory rules ( حکومت پاکستان کے وہ قوانین جو سول سرونٹ ایکٹ 1973 کے تحت بناۓ گۓ ھیں جو ہر حکو مت کے ھر سرکاری ملازمین پر استعمال ھوتے ھیں یعنی انکی تنخواہ، پنشن ، ٹرانسفر ،پرموشن ، ملازمت اور انکے خلاف انضباتی کاروائی وغیرہ وغیرہ کے قوانین ) لاگو ھونگے ( یعنی پی ٹی سی ایل میں انکا سٹیٹس سرکاری ملازمین جیسا ھوگا) اور انکے Terms and condition of services ( یہ سب سول سرونٹ ایکٹ 1973 میں دئے گۓ ھیں ) میں کسی قسم کی تبدیلی جو انکے نقصان کا باعث بنے ، نھیں آسکتی ( بی ٹی سی ایل یا پی ٹی ای ٹی کے بوڑڈز تو کجا فیڈرل گورنمنٹ کو بھی ممنوع قرار دیا وہ کوئی ایسی تبد یلی انکے terms and conditions میں لے کرآۓ جو انکے نقصان کا باعث بنے ) اور یہ فیڈرل گورنمنٹ کی گارنٹی ھے اور انپر فیڈرل گورنمنٹ کی پروٹیکشن رھے گی تاھم وہ لوگ جو ایل یکم جنوری 1996 کے بعد پی ٹی سی ایل میں ملازم ھوۓ یا جوائین کیا انکے لئے یہ سھولت نہ ھوگی انپر پی ٹی سی ایل کے اپنے بناۓ ھوے قانون لاگو نہ ھونگے اور انکو فیڈرل گورنمنٹ کی پروٹیکشن بھی میسر نہ ھوگی"... 
یھاں ایک بات میں واضح کردوں کے پاکستان ٹیلی کمیونیکیشن کار پوریشن میں دو طرح کے ملازمین تھے ایک وہ جو ٹی اینڈ ٹی سی دسمبر ۱۹۹۱ میں اس میں ٹرانسفر ھوے تھے اور ٹی اینڈ ٹی ختم ھو گئی تھی اور سیکشن ۹ پی ٹی سی ایکٹ ۱۹۹۱ کے مطابق ان سب کے قوانین پی ٹی سی میں وھی رھے جو ٹی اینڈ ٹی سے پی ٹی سی میں میں ٹرانسفر ھونے سے فورن پھلے تھے . پی ٹی سی نے بھی وھی گورنمنٹ والے قوانین اپنا لئے تھے ( یہ بات سپریم کورٹ کے اس مسعود بھٹی والے کیس کے فیصلے میں ، پیرا نمبر ۹ پوری طرح کسی شک اور شبہ سے واضح کی گئی ھے) . اور دوسرے وہ ملازمین جو پی ٹی سی میں باقاعدہ ریگولر بھرتی ھوۓ ان بر بھی پی ٹی سی میں یہی گورنمنٹ کے قوانین لاگو تھے اور جب یہ تمام ملازمین یکم جنوری 1996 کو پی ٹی سی ایل میں ٹرانسفر ھوۓ تو سب کی حثیت یہاں پی ٹی سی ایل میں بھی سرکاری ملازمین کی ھوگئی جیسا میں نے اوپر بیان کیا ھے مگر یاد رھے ان ملازمین میں وہ ملازمین شامل نھیں جو ورک چارج پر، کنٹریکٹ پر یا ایڈہاک بیس پر ٹی اینڈ ٹی یا پی ٹی سی میں بھرتی ھوے اور بعد میں پی ٹی سی ایل میں آنے اور یکم جنوری 1996 کے بعد ریگولر یا کنفرم ھوے ھوں یا ایسے لوگ جنکو اپائٹمنٹ لیٹر تو پی ٹی سی میں ملا مگر انھوں نے پی ٹی سی ایل یکم جنوری 1996 کے بعد جوائین کیا

PTCL Pensioners had been deprived of increases in Pension and Medical Allowance since 2010 as per Government of Pakistan announcements.They had been fighting for their usurped right at all forums.Islamabad and Peshawar High Courts had already decided in PTCL Pensioners favour.

The Supreme Court of Pakistan in its historic judgement,dismissed all appeals filed by Pakistan Telecommunication Employees Trust and Pakistan Telecommunication Company Limited on 12-06-2015 and ordered that all the employees of T&T Department have the status of Civil Servant even after its privatization.They are entitled for all benifites announced by the Government of Pakistan from time to time.

PTET has curtailed upto 53% pension plus Medical Allowance of the PTCL Pensioners  for last five years.Congratulations to about fourty thousand  PTCL Pensioners across the country.

All Pakistan PTCL Pensioners Action Committee will continue its efforts till the payment of all outstanding dues including Double pension,Cost of Living Allowance @ 7% and Revision of Pay Scales etc under the leadership of Mr.Ikramullah,Convener APPPAC

پی ٹی سی ایل انتظامیہ نے گزشتہ دنوں وی ایس ایس پیکیج کا اعلان کیا ہے جس کے تحت ملازمین صرف اور صرف اپنی مرضی سے گولڈن شیک ہینڈ لے کر ملازمت سے علئحیدہ ہوسکتے ہیں۔ ایک طرف تو پی ٹی سی ایل انتظامیہ نے یہ کہا ہے کہ ملازمین صرف اور صرف اپنی مرضی سے اس سکیم میں اپنے نام بھیجیں اگر وہ خود چاہیں تو۔ مگر پچھلے کئی دنوں سے پی ٹی سی ایل کے مستقل ملازمین کو انتظامیہ کی جانب سے دھمکیاں دی جارہی ہیں وہ ملازمت سے علیحدہ ہوجائیں اور وی ایس ایس سکیم میں حصہ لیں ورنہ اُن کو نوکریوں سے نکال دیا جائے گا۔ جو سراسر زیادتی اور ناانصافی اور انتظامیہ کی ہٹ دھرمی ہے۔ یہ لوگ ملازمین سرکاری ملازم ہیں، اور انہیں زبردستی نوکری سے نہیں نکالا جاسکتا۔ قانون موجود ہے۔

Please write the application/letter/E-Mails to the President of Pakistan, Prime Minister of Pakistan, Chief Justice of Pakistan & Human Rights Cell of Supreme Court of Pakistan for grant of relief, Cancellation of your illegal Transfer and protection from PTCL's Administration un law full activities.

We would like to request to all PTCL's Employees to write applications/letters and approached telephonically, telegraphically and by e-mails or other sources so that the pressure could be built up. We may not tolerate this disparity/ discrepancy which is against our fundamental right.

Islamabad (August 2, 2012) – PTCL has announced Annual Bonus / Reward Money for the year 2011-2012 of all employees (Management and Non-Management).

According to notification issued on Wednesday, August 1, 2012 No.TM&L/Bonus/2012

Bonus for PTCL employees (Regular, NCPG and NTC) will be as under:

Bonus for Employees Grade 1 to 19 = One basic Pay subject to
Minimum = Rs. 9000/= ::::::::::::::::::::::::::: Maximum = rs. 17000/=
GM or equivalent = Rs. 25000/= :::::::::::: EVPs = Rs. 30000/=

Subject: Payment of Bonus to PTCL Employees for the Year 2011-12

The PTCL management has decided to grant the Bonus to all Regular, NCPG, and NTC employees on the occasion of Eid ul Fitr as per the following details:

1. ELIGIBILITY

Employee Category (Regular, NCPG & NTC)

Employees in Grade 1-19 or equivalent (including PTCL D/Wages)

Bonus Amount

1 Basic Pay subject to

- Min. Rs. 9,000

- Max. Rs. 17,000

GMs or equivalent Rs. 25,000

EVPs Rs. 30,000

2. OTHER CONDITIONS

I. Only those employees will be eligible for bonus:

a. Who are in PTCL service on the date of issuance of this notification
b. Who have at least performed duty for 90 days during the year 2011-12
c. The payment will, however, be made prorate to the period of working during 2011-2012 if fulfilling the condition at (a) and (b) above

II. Employees undergoing any disciplinary proceedings against them will not be entitled for bonus.

III. Any person found involved in any illegal activity damaging company’s reputation shall not be eligible for this bonus.

IV. Any clarification or query regarding this process will be decided by the SEVP (HR) on case to case basis.
