According to this Notification, to convey that the rate of mark-up on State Provident Fund, i.e. General Provident Fund (GP Fund) for the fiscal year 2019-2020 is as under:-

GP Fund Subscription Rates 2016 for FG Employees

According to this Notification, consequent upon the revision of basic pay scales 2016 for the Federal Govt Employees, it has been decided to revise the rates of subscription toward General Provident Fund (GP Fund).

The new deduction of GP Fund shall be made in the bill of August to be paid on 1st September 2016 until further orders. There shall be no option to postpone subscription to the above fund either during leave except EOL without Pay or during the training period.

PROTECTION OF PAY OF GAZETTED CONTRACT EMPLOYEES ON REGULARIZATION/APPOINTMENT ON REGULAR BASIS
Government of Pakistan, Finance Division has issued Notification No. F. No. 4 (2) R-2/2014-237 dated 07-04-2015

The proposal for protection of pay last pay drawn by the contract employee on their regularization/appointment on regular basis are received in Finance Division and considered/decided on case to case basis. The existing rules/orders on the subject don’t provide for protection of pay of gazetted contract employees on their regularization. The Courts have held from time to time that the pay of gazetted contract employees on their regularization/appointment on regular basis should be protected. The matter has been examined in the light of Court’s judgments and it has been decided to issue general policy guidelines in this regard. The pay of the Gazetted Contract Employees on their regularization/appointment on regular basis will be protected subject to the following conditions:

  • That the contract appointment has been made in a BPS on standard conditions and terms circulated by Establishment Division as amended from time to time.
  • That the contract employee has applied through proper channel and has been properly relieved by the appointing authority. This condition shall not apply in case of regularization on the same post.
  • The regularization/appointment on regular basis has been made with the approval of competent authority.
  • That there is no break/interruption between regular and contract service.
  • That the service rendered on contract basis shall not qualify for pension and gratuity purposes.
  • That in the case of regular appointment from higher grade to lower grade, the pay shall not be protected.




Grant of Special pay @20% of Basic Pay All federal Secretaries
Government of Pakistan Finance Division has issued Notification No. F.1(5) R-4/95-Vol.IV.(1) dated 02-04-2015

According to this Notification it is directed to refer to this Division’s Office Memorandum No. F.1 (5) R-4/95 dated 31-07-2006 on the subject mentioned above and to state that Para No.2(ii) of the subject O.M dated 31st July 2006 has been substituted ab-initio, as under:

“Will be admissible on Basic Pay, being drawn or on the maximum of Basic Pay Scale-22 plus personal pay on account of annual increment, if any.


 
ADMISSIBILITY OF ANNUAL INCREMENT BEYOND THE SCOPE OF PAY SCALES (ABOVE CEILING)

It is clarified in this Notification that the employees who reached at the maximum stage of the Pay Scales of 2001 on or after 01-12-2001,they may also be allowed annual increment as personal pay upto a period of three years i.e 2002,2003,2004. After that, the benefit of annual imcrement beyond the pay scales as personal pay has been allowed to all the government servants w.e.f. 01-12-2005 under item-1 of Finance Division O.M No. 1(6)/Imp/2005 dated 13-10-2006. The increment may be considered as personal pay subject to the condition that the concerned employee has 6 months or more service as counts for annual increment.

The amount of personal pay may be considered for pay fixation, pension, gratuity and recovery of House Rent etc. It may not be reduced at the time of said purposes.

The clarifications, already issued in this context, may be treated to have been modified to the extent indicated above ab-initio.

GRANT OF BPS-17 TO THE SUPERINTENDENT (BPS-16) IN THE FEDERAL GOVERNMENT MINISTRIES/DIVISION/ATTACHED DEPARTMENTS / SUBORDINATE OFFICES

Finance Division is directed to convey that the Prime Minister has been pleased to accord approval to the grant of higher time scale to the Superintendents (BPS-16) in the Federal Government Ministries/Division/Attached Departments/ Subordinate Offices with immediate effect as under:

a) One time grant of BPS-17 to all Superintendents working in BPS-16 irrespective of their length of service.

b) In future three (03) years satisfactory service as Superintendent BPs-16 may be presicribed for grant of BPS-17 to them.

2. The grant of higher time scale will be subject to the following terms and conditions:-

i) The recruitment rules, nomenclature/tier of the posts and seniority of the Superintendents shall remain intact.
ii) The grant of higher time scale will be subject to fitness of candidate and recommendations of the relevant DPC.
iii) On grant of higher time scale pay will be fixed at the next above stage in BPS-17 and no pre-mature increment is admissible.
iv) On grant of higher time scale there shall be no change in the entitlement/admissibility of rental ceiling/House Rent Allowance/Medical Allowance.

As per this O.M::
Finance Division’s Clarification made to Auditor General of Pakistan vide letter No. F.1(48)Imp/94-1141 dated 22-01-1997. Copy attached)
In pursuance of the Supreme Court of Pakistan’s order passed in Civil Petition No. 1409 of 2011 and FST’s order dated 15th June 2011 passed in appeal No. 59(R) CS/2011.
With reference to the above, it has been decided that the advance increments allowed under the following Notifications:

Finance Division’s O.M No. F.1/7/Imp-II/87 dated 01-07-1987 read with O.M No. F.1(12)-Imp-II/91 dated 29-06-1991.
The Advance Increments are admissible prior to 01-12-2001 on acquiring/possessing higher technical as well as non-technical qualification irrespective of the fact whether the employee concerned is employed against a technical post or a non-technical post.

This decision will take effect from the date the advance increments were allowed.



According to the letter No. F.1(48)Imp/94-1141 dated 22-01-1997, I am directed to refer to your letter No.241/Reg-I/Adv.Inc/24-94/C/Vol-I dated 24-11-1996 on the subject cited above and to inform that the officials (BPS-11) who possessing or acquiring of Associate Engineer Diploma are entitled to Advance Increments on possessing/acquiring B.Tech (Hons), B.Sc (Engg) or M.Sc (Engg) in the relevant technology.

DISBURSMENT OF PAY AND ALLOWANCES/PENSION FOR THE MONTH OF JULY 2014 IN ADVANCE TO ALL F.G. SERVANTS & PENSIONERS ON THE OCCASION OF EID-UL-FITR

Attention is invited to Note 4 of Rule 217 to the Treasury Rules (Volume-I) which states that if the festival of Eid-ul-Fitr falls within the last ten days of a month, salary of that month may be disbursed in advance to all the Federal Government Employees and pensioners observing the festival. The advance should not be disbursed earlier than 5 days before the date of festival.

Eid-ul-Fitr will be celebrated on 29th July 2014(depending upon the sighting of moon). It is therefore requested that arrangements may kindly be made to disburse the salary and pension for the month of July 2014 to the Federal Govt Servants and pensioners on 25th July 2014.

According to this Notification one day salary of the officials/officers working in the Ministries/Divisions/Departments/Aurthorities/Corporations/Companies/Financial Institutions/Commission etc working under the Federal Government may be deducted and donated/deposited towards Prime Minister’s Relief Fund for IDPs-2014.

This deduction will be made from the bills of June 2014. This decision will be applicable to the following officials./officers:

Armed Forces Officers/Officials/Civilian Officers/Officials paid from defence estimates if not already deducted.

OPTION FOR RE-FIXATION OF PAY

As per O.M. dated 27th November 1999 says; the undersigned is directed to state that the terms of Finance Division’s O.M No. 3 (2) Gaz.Imp.I/75 dated the 14th October 1975, such civil servants who are promoted before reaching the maximum of their pay scales to a higher pay scale between 2nd June to 30th November of a year were allowed to opt to re-fixation of their pay in the higher pay scale concerned wef 1st of December of the year of their promotion with reference to their presumptive pay on that date in their pro-promotion scale.

While the said O.M dated 14-10-1975 did not cover the cases of selection grade (due to non-existence of Selection Grade Scheme at that time), the exercise of option for re-fixation in cases of selection grade and move over was barred vide this Division’s letter No. F.1(2) Imp/98-140/Imp/97 dated 30-04-1998; addressed to the Auditor General of Pakistan.

As Selection Grade is treated at part with promotion for the purpose of fixation of pay, it is decided in partial modification of this Division’s letter dated 30-04-1998, that the concession of option for re-fixation of pay in the higher scale as contained in this Division’s letter dated 14-10-1975 shall be extended also and applicable to the cases of Selection Grade with effect from the date it was barred by Finance Division i.e 30-10-1998.

Finance Division directed to refer to paragraph 17 of this Division’s O.M No. F.2(1)-Rev.1/72 dated 20 th  December 1972 has been amended from time to time and now it has been decided to amend the paragraph No. 17 (a) of the above mentioned Notification.
Existing Clause of the Rule  Amended Clause of the Rule
Actual Fare by Rail or Steamer of the class to which he was entitled immediately before his  retirement  for himself and for each member of his family. For  journeys  by Road between places not connected by rail or steamer,  mileage allowance shall be allowed. Actual fare by rail or air of the class to which he was entitled immediately before his retirement for himself and for each member of the family. For Journeys by road mileage allowance shall be allowed at the rates applicable at the time of drawl of the claim.
 
These orders are effective with immediate effect. No extra funds will be provided.

i Finance Division’s O.M dated 31st May 2013 does not contain any effective date of implementation. From which date will it take effect? The said O.M will take effect from the date of its issue i.e 31-05-2013.
ii Whether the pay of employees working on daily wages, short term vacancies and on contract basis, regularized by the Cabinet Sub-Committee is protectable? The pay of only those contract employees (Non-Gazetted) whose appointments have been made on standard terms & conditions in BPS by the competent authority is protectable.
iii Whether employees whose services were transferred from development to non-development side are entitled to pay protection? Pay is protectable of those employees only whose contract appointment in development side was made in BPS-01 to BPS-15 on standard terms & conditions.
iv Whether the pay of contract employees on their regularization in lower grades is protectable or otherwise? Finance Division’s OM clearly states that in case of regular appointment in lower grade pay shall not be protected.
v Whether the contract employees of BPS-01 to BPS-04 who were moved one scale up with effect from 1st July 2007 are entitled to pay protection on their regularization? Yes
vi In case the pay protection is allowed with effect from 31-05-2013 to all back date cases, please clarify about the date of pay fixation regarding date of regularization or implementation of this policy and whether payment of arrears after 31-05-2013 payable or not? As stated against (i) above
vii Whether an employee working in a Development Project on his appointment on regular basis in the Ministry/Division or Department is protectable? As stated against (iii) above
viii Whether the pay of an employee working on contract basis in the provincial Govt who later on joins a regular post in Federal Govt is also protectable? Yes, subject to the conditions as stated against (ii) above.

Amendment in Supplementary Rules Notification issued by Finance Division
Govt of Pakistan Finance Division Notification No. F.No.2 (1)/R-4/2004 dated 20th November 2013

In exercise of the powers conferred by sub-section (1) of section 25 of the Civil Servants Act 1973 (LXXI of 1973), read the Notification No. S.R.O.120 (I)/1998 dated 27th February 1998, the Finance Minister with the approval of Competent Authority is please to direct that the following further amendments shall be made in the Supplementary Rules namely:

In the aforesaid Rules, for Rule 12, the following shall be substituted, namely:

“12. Unless the President by special order otherwise directs:

a- One third of any fee in excess of one hundred thousand rupees received by a civil servant from consultancy shall be credited to General Revenues.

b- No civil servant other than the one appointed under statutory provisions shall be appointed to or nominated by the Federal Govt to the Board of Directors for more than one statutory corporation, autonomous body, institution, society etc., whether fully or partially owned or controlled by the Federal Government, in the interest of equality and justice.

c- The allowance, fee, honorarium etc in excess of six hundred thousand rupees per annum received by a civil servant as member of the Board of Directors of any one or more statutory, corporations, autonomous bodies, institutions, societies etc whether fully or partially owned or controlled by the Federal Government shall be credited to the General Revenue.

d- The upper limit of six hundred thousands rupees mentioned in paragraph (c) above shall include all other perks and privileges except the cost incurred on travel and lodging.”

Protection of Pay of Contract Employees on Regularization/
Appointment on Regular Basis
O.M. No. F.No. 79/)R-I/2012 dated 31st May 2013

Finance Division (Regulation Wing), Islamabad has issued Office Memorandum No. F.No. 79/)R-I/2012 dated 31st May 2013 in connection with the protection of pay of the contract employees on regulation or appointment on regular basis. The proposals for protection of pay last drawn by the contact employees on their regularization/appointment on regular basis are received in the Finance Division and considered/decided on case to case basis. The existing rules/orders on the subject don’t provide for protection of pay of contract employees on their regularization. The courts have held from to time that the pay of contract employees on their regularization appointment on regularization basis should be protected

That the contract appointment has been made on standard terms and conditions circulated by Establishment Division as amended time to time.
That the contract employee has applied through proper channel and has been properly relieved by the appointing authority. This condition shall not apply in case of regularization on the same post.
That regularization/appointment has been made with the approval of the competent authority.
That there is no break/interruption between contract service and regular service.
That the service rendered on contract basis shall not qualify for pension/gratuity purpose.
That in case of regular appointment in lower grade pay shall not be protected.

Ministries/ Divisions/ Departments are authorized to protect/fix pay in term of above guidelines. Only those cases may be referred to Finance Division where some clarification or advice of Finance Division is required.
